Welcome to Koit 👋
Koit is a personal organization and notes app for dates and relationships. It is exclusive for individual use (non-professional/non-profit) and only for those over 18 years old.
By creating an account, accessing, or using Koit, you confirm that you have read and agree to:
-
these Terms of Use; and
-
our Privacy Policy (where we explain how we collect, use, and protect data, in accordance with the LGPD in Brazil).
We may update these documents from time to time. When this happens, you will be notified within the app and/or through your registered channels.
In a nutshell (a summary that helps, but does not replace the Terms)
- To register, you must provide some personal information — handled and protected according to the LGPD.
- We expect safe, ethical, and respectful conduct: no misuse, fraud, harassment, violation of law, or privacy.
- If you have 12 months of inactivity, we may deactivate and/or delete your account, following retention and deletion rules compatible with the LGPD.
- Koit may display ads and offer paid features (subscription).
- In case of a dispute, we seek to resolve it first through mediation; if that is not possible, the venue is São Paulo – SP (Brazil).
- For now, Koit is not available to users in the European Union/EEA, while we finalize adjustments related to the GDPR.
Koit Tecnologia LTDA is responsible for the app and maintains the rights over its operation and content. Koit is not responsible for interactions outside the platform (e.g., in-person meetings, conversations on other networks, personal decisions), nor for misuse of the app (such as professional or profit-making purposes).
Important: this summary is only a reading aid and does not replace the full text. To continue using it, you need to read the entire document, okay? 😌
Our current stage as a company (soft launch / evolving)
Koit is still under development and validation. This means we may change, adjust, or remove features, fields, and screens — and, in some cases, this may affect service availability.
During this phase, certain data may be altered, migrated, or deleted due to technical changes and product improvements. We do this carefully, but it is important for you to know that the app is still evolving.
1. Territorial Restriction (European Union)
This service is not available to users located in the European Union/EEA. Koit Tecnologia Ltda. informs that, at this time, it does not offer its services to users located in any member country of the European Union, as we are in the process of adapting to local regulations. If you are accessing this service from a member country of the European Union, please discontinue use immediately. By proceeding with the use of the application, you represent and warrant that:
- You are not located in any member country of the European Union/EEA
- You will not access or use the service while in the European Union/EEA
- You understand that failure to comply with this restriction will result in the immediate termination of your account.
Koit Tecnologia Ltda has automatic geographic barriers in place through the Google and Apple app store platforms, which are not authorized to offer the application to their customers in European Union countries, effectively preventing the download of the application through its only official supply channel.
2. Introduction
These terms govern the relationship between you and A KOIT TECNOLOGIA LTDA (“KOIT”, “the COMPANY”) registered under CNPJ 53.815.531/0001-07, headquartered at Av. Paulista, 1106, Sala 01, Andar 16, CEP 01310-914, São Paulo - SP, responsible for the licensing, distribution, and delivery of the KOIT APP application (“the APPLICATION” and “KOIT”).
Therefore, it is essential that the user(s) (“you”) read carefully before proceeding, as there is important information here about your rights, duties, and responsibilities when using our services and the application.
In case of questions or support, official contact channels are available at the end of this document.
2.1 Notice for iOS (Apple) users
If you are using Koit on an iOS device, you and Koit acknowledge that this agreement (EULA/Terms of Use) is entered into exclusively between you and Koit, and not with Apple Inc. (“Apple”). Koit, and not Apple, is solely responsible for the Koit Application (iOS) and all content and operation related to it.
You also acknowledge that this agreement does not establish usage rules for the application that conflict with Apple’s applicable rules, including the Usage Rules and the Apple Media Services Terms and Conditions, in effect on the date you accept these Terms.
2.2. What Koit is (and what it is not)
KOIT is an advanced notes and personal organization application to assist in the management of dates and social relationships. It was developed to facilitate the recording of information such as nicknames, tastes, preferences, scheduled dates, and even expenses related to special moments in your life, always focusing on privacy and personal use.
Advanced note applications are tools for organizing daily information — like a “notebook,” only 100% digital. Therefore, KOIT is not a social network and does not offer a direct interaction channel between users within the application.
Important: KOIT is intended for personal use. It should not be used for professional, commercial, or service provision purposes.
2.3. Acceptance of these Terms
By accessing or using KOIT, you declare that you have read, understood, and fully agree with these Terms of Use, as well as the Privacy Policy, the Rules of Conduct, and the Child Safety Policy (when applicable).
2.4. Updates to these Terms
KOIT may update these Terms periodically to reflect improvements in the application, changes in services, and/or changes in applicable legislation. When there are relevant changes, you will be notified, usually within the application.
Continued use of KOIT after notification may be considered as acceptance of the new conditions. Still, it is your responsibility to review these Terms and other guidelines whenever possible.
3. Who is authorized to use the application?
You must comply with certain rules to use Koit’s services and the application. By proceeding with the creation of your account and use of the application, you declare that all the information below is true about you:
- You are over 18 years old and a natural person.
- You have no history of inappropriate behavior such as sexual crimes or physical violence, such as conviction or confession.
- You are not under an obligation to register as a sex offender in databases and/or records of authorities in any sphere.
- You are legally capable of understanding and accepting terms and contracts.
- You do not have any existing account in the application and have not been previously expelled/suspended/removed from the Koit application.
- You do not use and do not plan to use the application within the geographic region of the European Union/EEA.
- You plan to use the application as intended by Koit and within normal use, without the objective of interrupting or harming the application, servers, or networks, or preventing access to other users, nor for criminal or nefarious purposes, including crimes of any kind.
- You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country.
- You are not listed on any U.S. Government list of prohibited or restricted parties.
You also cannot register data of minors, facilitate the use, or be aware of improper uses and not take notification actions, according to our Child Safety Policy.
Failure to comply with the above rules means that you are no longer authorized to access the application and must stop use and request account deletion on your own initiative. You may also have your access revoked at any time, without prior notice, and be prohibited from future access to the application.
4. Account Creation and Management
Every user of the application must be the holder of their own account for personal use, providing complete, accurate, and updated information, and account sharing is prohibited. The account creation process establishes responsibilities between the parties involved; therefore, account sharing between people other than the user involved in the registration process is not permitted.
The registration process requires data such as name, email address, telephone number, and password, which will be used to ensure account security.
The user is entirely responsible for keeping their access credentials secure and confidential, avoiding sharing them with third parties. If you suspect misuse or unauthorized use of your account, the user must contact our service channels immediately.
We reserve the right to suspend or terminate accounts that violate these Terms or present suspicious activities. Detailed information about data collection and use is available in our Privacy Policy.
Koit reserves the right to terminate access for users who a) violate the terms of use b) present suspicious activities c) do not follow child safety policies d) are no longer authorized to use the application (section 3) e) do not access the application for 12 months and f) due to unilateral lack of commercial interest.
5. Rules of Conduct
We want every person to feel free to be who they are, without fear of judgment. Our commitment is to create a digital environment where diversity is welcome, safety is a priority, and authenticity is encouraged.
It is expected that each user treats others in their relationships with politeness and kindness, avoiding the recording, registration, and offensive notes, with insults or prejudice of any kind.
Therefore, you must follow the Rules of Conduct guidelines, available on the page https://koitapp.com/en/privacy-and-transparency/, also accessible at any time through the application in the “Profile” and “Transparency and Privacy” tab.
The application also cannot contain notes about minor users, or those who were minors at the time of the fact/meeting, according to the Child Safety Policy guidelines, available on the page https://koitapp.com/en/privacy-and-transparency/, also accessible at any time through the application in the “Profile” and “Transparency and Privacy” tab.
You agree to use your common sense when scheduling meetings, as you understand that it is not possible for us to guarantee your physical safety, given that the service offered is only an advanced notes application and does not accompany your meeting. You should take precautions in all your meetings and social events, such as: scheduling in public places, staying alert for suspicious behavior, and notifying your friends and sharing your real-time location with them.
5.1 User Commitments
Furthermore, the user commits not to perform or use the application as a basis for acts that constitute inappropriate, invasive, or dangerous behavior, whether in virtual or in-person interactions. The user is not permitted to use the application to, for example:
- Coerce or pressure another person to perform any act against their will, whether by physical, emotional, or sexual means.
- Ignore personal boundaries previously established by another person, insisting on or repeating behaviors that were clearly refused.
- Adopt abusive behaviors, including verbal aggression (such as insults and humiliations), threats, or any form of physical violence.
- Induce, force, or encourage the consumption of alcohol or illicit substances, or use such substances irresponsibly, putting third parties at risk.
- Emotionally manipulate another person to gain advantage or control, including strategies that generate guilt, obligation, or embarrassment.
- Participate in conduct that may cause discomfort, fear, or any type of threat to the physical or emotional well-being of third parties.
This list is not exhaustive. For more information, consult the Rules of Conduct guidelines (clause 5 above).
6. Content and Property
You are fully responsible, legally and personally, for the content entered into the application. The user declares to be the owner of or have rights to the personal content and notes they enter into the application, such as photos, notes, and profile descriptions. Therefore, you agree to indemnify, hold harmless, and defend Koit from legal requests and events arising from your content and use.
The creation, annotation, and/or upload of content that violates copyright, includes nudity, explicit violence, references to inappropriate content, or apology for crimes is expressly prohibited. Any material considered improper will be removed immediately and legal measures may be taken. For more information, consult the Rules of Conduct section (clause 5 above).
By using the application, the user grants Koit a worldwide, royalty-free, transferable, and sublicensable (non-exclusive) license to use, replicate, reproduce, host, store, operate with subprocessors, and make available to the user the operation of the application and also as eventual intelligence for application updates. This also includes information that may be shared during access through third parties (for example, login via social networks).
To report content in conflict with intellectual property laws, contact legal@koitapp.com
7. Security and Privacy
Protecting our users is a priority. We adopt appropriate technical, organizational, and procedural barriers to protect your data against unauthorized access or improper use, in compliance with the General Data Protection Law (LGPD). These barriers consecutively mitigate the risks of improper access.
You must not store in the application data related to banking data, payment information (e.g., credit card, accounts, Pix keys), related to you or any other person. We are not an application capable of receiving, processing, or storing this information and you must not, in any way, store data of this type.
Even with all the safeguards implemented at the database level, access, and other barriers, you should avoid storing sensitive personal data information or information that you would not want others to see. You should mitigate risks by saving, for example, contacts preferably with nicknames and not full names as a privacy strategy and general risk mitigation.
Additionally, to comply with applicable legislation, including the General Data Protection Law (LGPD), we inform you that there is a possibility of certain users having part of their notes or information deleted, in case of a determination that some information was recorded improperly, which may occur, for example, in case of a request from a data subject or for other reasons supported by law.
For more information, consult the Privacy Policy, which is mandatorily binding on all users of the application and you agree to be bound by it through the acceptance of these Terms of Use.
Your rights as a data subject, communication channel with the ANPD, and the Privacy Policy guidelines are available on the page https://koitapp.com/en/privacy-and-transparency/, also accessible at any time through the application in the “Profile” and “Transparency and Privacy” tab.
8. Well-being and responsible use
Koit is a personal organization tool and does not offer medical, psychological, or therapeutic advice. Use the application in a balanced way and, if you notice that social interactions or relationships are causing suffering, intense anxiety, or harm to your daily life, consider seeking professional support.
If you are at immediate risk of hurting yourself or someone else, seek urgent help from local emergency services.
9. Protection of Minors
The registration and use of the application by minors, adults who relate to minors, or the storage of data referring to minors at the time of the recorded facts (non-exhaustive list) is strictly prohibited.
If any of these situations are identified, measures may be taken according to severity, including user suspension, account exclusion and banning, and reporting to the Public Prosecutor’s Office and Federal Police or responsible local authority in cases outside the Federative Republic of Brazil.
You can learn more about our values, adopted barriers, and rules in the Child Safety Policy guidelines, available on the page https://koitapp.com/en/privacy-and-transparency/, also accessible at any time through the application in the “Profile” and “Transparency and Privacy” tab.
10. Purchases and Subscriptions
You may have the opportunity to make purchases and/or subscriptions within the Koit application. If you enter into a subscription, after signing the contract, it will be automatically renewed and you will be automatically charged until cancellation by the user. At the time of the decision, you will have access to the application’s terms and conditions.
After canceling the subscription, you will continue to have the benefits until the expiration date. In this way, in general, we do not perform pro-rata refunds after payment. In cases of billing disputes, you must contact your app store support, as they are the external payment processing services.
At the time of cancellation, the terms signed at the time of purchase and/or subscription may cease to be applicable, according to the specific terms of each purchase and/or subscription.
We may at any time stop offering the subscription, impose conditions for a certain discount or promotion, prevent users from performing transactions for reasons identified by us as reasonable, and change prices according to various factors that impact prices such as inflation and increased costs, for example.
These purchases and/or subscriptions may be processed and managed through an external service such as your phone’s app store. For iOS phones, the Apple App Store becomes the external service responsible for processing and management. For Android phones, the Google Play Store becomes the external service responsible for processing and management.
10.1 Purchases, subscriptions, and refunds via App Store (iOS / Apple)
When a purchase, subscription, or renewal is made on iOS through the App Store, you acknowledge that payment processing, subscription management, and any refunds are conducted by Apple, in accordance with the applicable App Store terms and policies.
In these cases, Koit cannot process refunds externally for purchases made via the App Store. Any refund request, billing dispute, or adjustment related to a transaction performed by the App Store must be handled through Apple’s channels, according to its rules.
In the event of the application’s failure to comply with an applicable warranty, you may notify Apple, and Apple may refund the purchase price of the application (when applicable), as provided in the App Store policies and applicable legislation.
11. Dispute Resolution
Any disputes related to the use of the platform should preferably be resolved through mediation. If this is not possible, the court of the district of São Paulo - SP is elected as competent to resolve any judicial conflicts.
12. Shared Responsibility; and Disclaimer.
Koit is not responsible for interactions that occur outside the platform, and it is the user’s responsibility to evaluate and manage the risks associated with these interactions. This demonstrates the need to follow a concept known as Shared Responsibility.
To exemplify this shared responsibility relationship, you will find below a table with non-exhaustive and merely illustrative examples of each scenario.
| Area | User Responsibility | App Responsibility |
|---|---|---|

| Data Sharing | Do not register sensitive information unnecessarily for use of the application and/or banking data or others specified above. | Restrict improper uses, ensuring that information is not used for unauthorized purposes. |
| Problem Reporting | Report suspicious behavior, security violations, or identified vulnerabilities. | Maintain support channels for reports and act within the timeframe to resolve security or behavior issues. |
| Access Monitoring | Access the app only on trusted devices and secure networks. | Monitor system activity to identify suspicious access or security violations. |

14. Intellectual Property Rights
The application and all Koit services, including its components, design, logos, visual identity, inventions, textual content, visual elements, features, and the underlying software, are the exclusive property of Koit Tecnologia Ltda and/or used with the pertinent authorization of its authors and/or responsible parties. These elements are protected by applicable intellectual property laws in Brazil and internationally.
The user receives a limited, non-exclusive, revocable, and non-transferable license to use the application according to the conditions established in these Terms of Use. This license does not imply any transfer of ownership or granting of rights over the company’s intellectual assets. It is strictly prohibited to copy, modify, distribute, sell, or exploit (commercially or otherwise) any part of the application without prior and express authorization.
14.1 Scope of License (iOS / Apple users)
When Koit is downloaded and used on an iOS device, the license granted to the user for the use of the application is limited to a non-transferable license to use the Application on Apple products that the user owns or controls, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
Without prejudice to the above, the Application may be accessed and used by other accounts associated with the purchaser through Family Sharing or volume purchasing, when applicable and as permitted by Apple.
14.2 Third-Party Intellectual Property Infringement Claims (iOS / Apple users)
When Koit is downloaded and used on an iOS device, you acknowledge and agree that, in the event of any third-party claim alleging that the application (or your possession and use of the application) infringes third-party intellectual property rights, Koit, and not Apple, will be solely responsible for the investigation, defense, settlement, and eventual resolution of such claim, including its discharge and termination.
15. Indemnification
The user agrees to indemnify and hold harmless Koit Tecnologia Ltda, its partners, employees, partners, and suppliers from any losses, damages, liabilities, costs, and expenses (including attorney’s fees) arising from the improper use of the application, violation of these Terms of Use, guidelines, or any applicable law.
This obligation includes, but is not limited to, violations that result in damage to other users, improper use of protected content, or actions that cause harm to the company’s reputation or operations.
16. Third-Party Links and Services
The application may contain links to or integrate third-party services. These contents and services are made available for the user’s convenience, and Koit assumes no responsibility for their accuracy, safety, legality, or operation.
By accessing external links or using third-party services integrated into the application, the user acknowledges that they are subject to the terms and policies of those parties. It is your responsibility to review these documents before interacting with such services. Koit is not responsible for any damages or losses arising from the use of content or services provided by third parties.
16.1 Third-Party Terms
By using Koit, you agree to comply with any applicable third-party terms that are necessary for the use of the application, including, for example, the terms of your internet provider/carrier, operating systems, and app stores (such as App Store and Google Play), as well as any services integrated or accessed by Koit.
17. Disclaimer of Warranties
The application is provided “as is” and “as available.” Koit does not guarantee that the services will be uninterrupted, error-free, or completely secure. All warranties, explicit or implicit, including, but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement, are disclaimed to the maximum extent permitted by law.
The user acknowledges that the use of the application is at their own risk, and that the company is not responsible for technical problems, losses in commercial relationships - not recommended -, connection failures, or other factors outside its control.
17.1 Warranty (iOS / Apple users)
When Koit is downloaded and used on an iOS device, you acknowledge and agree that Koit is solely responsible for any warranties related to the application, whether express or implied, to the extent that such warranties are not validly disclaimed by applicable law.
In the event of any failure of the application to comply with an applicable warranty, you may notify Apple, and Apple may refund the purchase price of the application to the end user (when applicable). As Koit may be made available for free, you acknowledge that the “purchase price of the application,” when non-existent, may be equal to zero.
To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to comply with a warranty will be the sole responsibility of Koit.
For purchases made within the application on iOS (including subscriptions), you acknowledge that payment processing and management and any refunds may be performed by Apple, in accordance with the applicable App Store terms and policies.
18. Limitation of Liability
In the free version of the application, Koit, to the maximum extent permitted by applicable law, is not responsible for indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the service.
For users of paid versions (including subscriptions), Koit’s total maximum liability, to the maximum extent permitted by applicable law, will be limited to the amount actually paid by the user to Koit in the last 12 (twelve) months preceding the event that gave rise to the claim, unless applicable law requires otherwise.
18.1 Claims about the Application (iOS / Apple users)
When Koit is downloaded and used on an iOS device, you acknowledge and agree that any claims by the end user or third parties related to the application or the possession and/or use of the application — including, but not limited to: (i) product liability claims; (ii) allegation that the application does not comply with applicable legal or regulatory requirements; and (iii) claims under consumer protection, privacy, or similar legislation (including, where applicable, in connection with frameworks such as HealthKit and HomeKit) — will be handled and addressed by Koit, and not by Apple.
You acknowledge and agree that Apple is not responsible for such claims.
18.2 Limitations permitted by law
The limitations and exclusions of liability provided in this section apply only to the maximum extent permitted by applicable law. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, nor restricts non-derogable consumer rights when applicable.
19. Force Majeure
Koit will not be held responsible for failures or delays in fulfilling its obligations due to events beyond its reasonable control. These events include, but are not limited to, natural disasters, government acts, telecommunications or network infrastructure failures, cyberattacks, and pandemics. In these situations, Koit will seek to minimize the impacts on the provision of services, but does not guarantee continuity.
20. Severability and Waiver
If any provision of these Terms of Use is considered invalid or unenforceable by a competent authority, the remaining provisions will remain in full force and effect.
Periods of time that may be perceived as silence by Koit in demanding compliance with any clause or right contained in these Terms will not be interpreted as a waiver of those rights, which may be exercised at any time.
21. Entire Agreement
These Terms of Use, together with the Privacy Policy and other applicable additional terms, constitute the complete agreement between Koit and the user, superseding any prior understandings or communications, whether written or oral.
21.1 Third-Party Beneficiary (iOS / Apple users)
When Koit is downloaded and used on an iOS device, you and Koit acknowledge and agree that Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms, in the part applicable to the use of the application on iOS.
Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted that right) to enforce these Terms against you as a third-party beneficiary, to the extent applicable.
22. Language and Translations
In case of discrepancies between translated versions of these Terms of Use and the original Portuguese version, the Portuguese version will prevail for residents in Brazil. The English version prevails for residents outside Brazil.

These Terms of Use do not create any agency, partnership, joint venture, or employment relationship between the user and the company. The parties remain independent, and the use of the application does not change this relationship.
30. Duration and Termination
These Terms remain in effect as long as the user maintains their account active in the application. The user can request the closure of their account at any time in a self-service manner within the application in the “Profile” and “Delete Account” tab, starting a 30-day cooling-off period after which there is no recovery of data.
31. Maintenance and Support
